Shortwave is operated by Clipdeco arts ("we", "us", "our"). By creating an account or using the service you are entering into a binding agreement with Clipdeco arts.

By accessing or continuing to use Shortwave you agree to be bound by these Terms & Conditions. If you do not agree, do not use the service. You confirm that you are of legal age in your jurisdiction and, if acting on behalf of an organisation, that you have authority to bind it.

Shortwave is an AI-powered tool that ingests video content you provide and produces short-form clips, transcripts, hook scores and social captions. The exact features available depend on your subscription plan.

You must not, and must not allow others to:

• Use the service for any unlawful, fraudulent or abusive purpose, including spam.
• Upload content that infringes intellectual property, privacy, or publicity rights.
• Generate, request or distribute illegal content, deepfakes intended to deceive, hate speech, harassment, sexual content involving minors, or malware.
• Attempt to jailbreak, bypass safety filters, reverse engineer the service, scrape it, or probe it for vulnerabilities.
• Resell, sublicense or redistribute the service or its outputs in violation of these terms.

You retain ownership of the videos and other materials you upload ("Inputs") and of the clips, captions and other materials produced from them ("Outputs"). You grant us a limited, worldwide, non-exclusive licence to host, transcode, process and analyse Inputs and Outputs solely to provide the service to you.

You are responsible for ensuring you have all necessary rights and consents to upload your Inputs and to use the Outputs in the channels where you publish them. AI outputs may be inaccurate or incomplete; verify them before publication and do not rely on them as professional, legal, medical or financial advice. We may filter, restrict or remove Outputs and suspend accounts that repeatedly infringe third-party rights or breach these terms.

The Shortwave service, its software, models, branding and documentation are owned by Clipdeco arts and protected by intellectual property laws. Subject to these terms we grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscription fees, billing intervals, tax, currency conversion, cancellations and refunds are governed by the Paddle Buyer Terms. Our own refund window is set out in our Refund Policy. You can cancel a subscription at any time; access continues until the end of the paid period.

We may suspend or terminate your access where you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our acceptable use policy. You may stop using the service at any time. On termination, we will delete or anonymise your data within a reasonable period unless required to retain it by law.

We work hard to keep Shortwave reliable, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, our aggregate liability arising out of or related to the service is capped at the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or punitive damages, including loss of profits, revenue, data or goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

You will indemnify and hold harmless Clipdeco arts from claims arising out of your Inputs, your use of Outputs, your breach of these terms, or your unlawful use of the service.

We may update the service or these terms from time to time. Material changes will be communicated in-app or by email. Continued use after changes take effect constitutes acceptance.

These terms are governed by the laws of the jurisdiction in which Clipdeco arts is established, without regard to its conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction over disputes, subject to any mandatory consumer rights you have where you live.
